1. Who this policy applies to
This Policy explains how Fxbinaryempire collects, uses, stores and shares personal data when you visit the website, register, complete identity review, fund an account, trade, contact support or interact with administrators. Fxbinaryempire acts as the data controller for platform account information unless stated otherwise.
2. Information we collect
- Account and contact data, including name, username, email, telephone number and country information.
- Identity-review data, including identification documents, document details, selfies, review notes and verification status.
- Financial and payment data, including M-Pesa phone and receipt references, PayBill account references, deposit and withdrawal records, conversion amounts and wallet balances. We do not receive your M-Pesa PIN.
- Trading data, including account mode, markets, orders, stakes, entry and settlement prices, outcomes, automated settings and transaction history.
- Security and technical data, including IP address, device/browser information, login time, failed attempts, session state, audit records and security restrictions.
- Communications, support requests, administrator notes and notification engagement.
3. Why we use information
We use personal data to create and secure accounts; provide demo and live services; process and reconcile payments; calculate balances and settlements; conduct KYC, fraud and compliance review; provide support; send service notifications; maintain audit records; diagnose faults; enforce terms; comply with lawful requests; and improve reliability and user experience.
4. Legal grounds
Depending on the processing, we rely on performance of our agreement with you, compliance with legal obligations, legitimate interests such as security and fraud prevention, protection of legal claims, and consent where consent is required. You may withdraw consent for future consent-based processing, but this does not affect earlier lawful processing or information required to provide the service.
5. Sharing and service providers
We may share necessary information with payment and telecommunications providers such as Safaricom; live-chat provider Tawk.to when you use chat; hosting, database, security and communications providers; professional advisers and auditors; identity or compliance providers if introduced; and regulators, courts or law-enforcement bodies where legally required. Administrators receive role-based access for support, finance, security and compliance work. We do not sell personal data.
6. International processing
Infrastructure or service providers may process information outside Kenya. Where personal data is transferred internationally, we take reasonable steps to use legally recognized safeguards and assess the protection available, as required by applicable law.
7. Retention
We retain account data while the account is active and for a reasonable period afterward. Financial, KYC, security and audit records may be retained longer where necessary for compliance, fraud prevention, dispute resolution, reconciliation and legal claims. When information is no longer required, we delete, anonymize or securely isolate it, subject to technical and legal limitations.
8. Security
We use measures including access controls, password hashing, encrypted transport, restricted KYC storage, session controls, transaction locking, callback validation, rate limits and administrator audit records. No internet service can guarantee absolute security. Protect your password and contact us promptly if you suspect unauthorized activity.
9. Your rights
Subject to applicable law, you may ask to be informed about processing; access your personal data; object to some processing; correct false or misleading data; request deletion where applicable; and request data portability. Some requests may be limited by payment, fraud-prevention, legal-retention or third-party rights. We may verify your identity before acting on a request.
10. Cookies, chat and local storage
We use essential cookies and browser storage for authentication, security, preferences such as theme, and core interface operation. The Tawk.to live-chat widget may also use cookies or similar technologies to operate chat, remember a conversation and protect the service. Blocking storage may prevent login, chat or other features from working. If additional non-essential analytics or advertising technologies are introduced, we will provide any consent controls required by law.
11. Children
The service is not intended for anyone under 18. We do not knowingly permit minors to open trading accounts. Contact us if you believe a minor has supplied personal data.
12. Requests, complaints and updates
Send privacy requests to [email protected]. You may also lodge a complaint with Kenya’s Office of the Data Protection Commissioner. We may update this Policy as services or legal requirements change; the revised effective date will appear above and material changes will receive appropriate notice.
